Chapter 7 Bankruptcy:

Chapter 7 is a powerful tool, used to wipe out your debt, both Business and Personal.  It will stop all collection actions against you, stop all lawsuits and harassing phone calls and even get you out of a lease on your business property

When your case is filed, the Federal Bankruptcy Judge, immediately issues a Court Order, barring all actions against you, including any action to collect on any debts.  This is why Foreclosures, Wage Garnishments, Lawsuits and Collections are all stopped, when you file for bankruptcy

This process is immediate, and therefore a Bankruptcy filed at 9:00 a.m. will stop a trustees sale set for 10:00 am, that same day.

The Court lets you keep most, if not all of your property, when you file for Bankruptcy.  The reason is,  the Court does not want you to have to go right back into debt, after you file, so they will let you keep your car, all your household possessions, your home and your retirement accounts.

Our office files your case "electronically".  That is when the Bankruptcy Protection starts.  It is immediate. About 6 weeks later, you will need to go to the Court and meet with a Bankruptcy Trustee.  They will have already reviewed your paperwork and will ask for documents proving your identity, ie drivers license and social security card.  They will then ask you to verify that you listed all of your debts and all of your assets. They will then ask if any creditors are present with any questions (which their almost never are)  and then you are free to go.  The whole process takes only a few minutes, when done properly.  We have been specializing in Bankruptcy Law since 1981, and know how to get the job done properly

The Court will issue a discharge of your debts and your case will be concluded.  The discharge usually is issued about 6 weeks after your "Meeting of Creditors". Chapter 13:

We can stop a foreclosure, pay back missed house payments at 0%, and "strip" off 2nd or 3rd Mortgages on your home, by filing a Chapter 13 Bankruptcy

Chapter 13 is a repayment plan, where you pay what you have left over from your income each month, after expenses, to a trustee, who then pays your creditors. Plans last from 3 to 5 years.  You do not have to pay 100% of your debt, in fact many plans only pay 2% or 3% of the debt, but at the end, if you have made all Chapter 13 payments, all of your debt is forgiven. 100% forgiven.  

You can pay back any missed payments you may have on your home mortgage, at 0% interest.  If your home is worth less than what you owe on your 1st mortgage, you can "strip" off any 2nd mortgages, and pay them with the rest of your unsecured debt.  That means, at the end of your plan, you will have paid off both your credit cards as well as your 2nd mortgage, and probably for only pennies on the dollar.

As long as you are making your payments, the Court will provide protection, preventing foreclosure, wage garnishment and any collection attempts against you.  Chapter 13 is a powerful tool, and should be given serious consideration by anyone in financial trouble

Chapter 11:

Chapter 11 is a powerful way to reorganize your debt, and pay your creditors, what you can afford, as opposed to what they are demanding.  It is ideal to keep you business "afloat" while you restructure your debt.

You do not need to be a Fortune 500 company to file for protection under Chapter 11.  It is available to all, and is a valuable tool for most small and medium sized businesses as well as Fortune 500 companies.   

You may continue to operate your business while under the protection of Chapter 11.  You may continue to pay your employees, and your vendors, to insure that your business stays "afloat". 

In most cases, you operate as a Debtor in Possession, and have complete control over your business.  You must report your financial status to the Court, every 30 days, and you have 4 months to come up with a plan of reorganization. The Plan is then submitted to your creditors for a vote, and if approved, it is confirmed by the Court.  If not approved, we can ask the Court to "Cram Down" the plan.

While typically used for business purposes, Chapter 11 may also be used to salvage a piece of Real Property.  For example, if you have a home with a Fair Amount of Equity in it, but you can no longer make your Mortgage Payment, and are being threatened with foreclosure, we can buy time to sell the home or refinance, while under the protection of Chapter 11.
